We provide the following as needed services (the "Service"): personalization services for one (1) design/image for use with one (1) personalized masthead for an individual website to be operated under Our Terms of Service (the "Site") available at our website (terms of service) and these Terms of Use. You desire to subscribe to the Service on the terms and conditions contained herein. Orders for Services should be placed by Your website administrator for a Site.

We agree to provide You with the Service that shall include access to Our design services whereby You may choose from Our designs and templates (“Templates”) and specify changes to typefaces, colors and other features to personalize the Template. You have twelve (12) months from the date of ordering the Service to submit to Us Your requested changes to the chosen Template and to provide Us with Your selected personal image/logo, if any, for inclusion on the Site. Our designers will use the requests and images (and logo) to creatively personalize the website design of the Site. We will then provide You with a proof version of the personalized Site design for You to review, and You must approve or make suggested revisions to such personalized design within thirty (30) days from the date of delivery of the proof to you from Us. During this review period, You may consult, via telephone or Skype, with the Site designer assigned to your account for a single thirty (30) minute review session.

Axletree Media, Inc. shall own all right, title and interest in all Axletree Media, Inc. technology and work product associated with the Site and the Service. Should You choose to cancel Your subscription at any time, Axletree Media, Inc. will continue to own the technology, graphics, and images supplied by Axletree Media, Inc. for Your Site. We assume no responsibility for the protection of any data, images or other content uploaded by You to the Site. You retain ownership of Your data and any images you uploaded to the Site, in the form originally uploaded. All right, title and interest in any and all modifications made to the data and images you upload shall be owned by Axletree. You may in no way use the Services, Templates or modified images to develop a web site with another service provider or on an individual basis.

For clarity, you retain any and all of your ownership rights in the data and images you submit to Us. However, by submitting data and images to us, you hereby grant Axletree a worldwide, non-exclusive, royalty-free, irrevocable, sublicenseable and transferable license to use, reproduce, distribute, transmit, broadcast, host, Stream, prepare derivative works of, display, and perform the data and images in connection with Axletree's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Axletree websites and services (including the Services hereunder) (and derivative works thereof) in any media formats and through any media channels.. The above license granted by You is perpetual and irrevocable.

In connection with images and data You may submit to Us, You further agree that you will not submit material that is copyrighted, protected by trade secret, or otherwise subject to third party proprietary rights, including trademark rights, and privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to use the material and to grant Axletree all of the license rights granted herein and in the Terms of Service incorporated by reference.

The terms and conditions of the Terms of Service available at our website (terms of service) are hereby expressly incorporated by reference and shall be fully applicable to the Services specifically described in these Terms of Use.
